TJX Settles suits with 41 states for $9.75 million

"After settling with consumers and banks that alleged the company's lax computer security enabled a massive data breach, discount retailer TJX has agreed to pony up $9.75 million to 41 states. According to TJX's agreement with the attorneys general, $5.5 million of the funds will be earmarked for the states' data protection and consumer protection programs and $2.5 million will go into a Data Security Trust Fund for enforcement efforts. The remaining $1.75 million will reimburse attorneys general for the costs and fees of the investigation. "

In Legal First, Data-Breach Suit Targets Auditor

When CardSystems Solutions was hacked in 2004 in one of the largest credit card data breaches at the time, it reached for its security auditor’s report.

In theory, CardSystems should have been safe. The industry’s primary security standard, known then as CISP, was touted as a sure way to protect data. And CardSystems’ auditor, Savvis Inc, had just given them a clean bill of health three months before.

Yet, despite those assurances, 263,000 card numbers were stolen from CardSystems, and nearly 40 million were compromised.

More than four years later, Savvis is being pulled into court in a novel suit that legal experts say could force increased scrutiny on largely self-regulated credit card security practices.

Privacy Group Asks F.T.C. to Investigate Google

The Electronic Privacy Information Center formally asked the Federal Trade Commission on Tuesday to investigate the privacy and security safeguards of Gmail, Google Docs and other so-called cloud computing services offered by Google to consumers.
